Bank Windhoek is recruiting a Head: Legal Collections (m/f), to be based in Windhoek, Namibia.
Description
  • Responsible and accountable for effective and efficient management of legal collection activities of the Branch in managing the pre-legal and non-performing loans in compliance with the Bank’s credit policy and procedures
Duties
  • Strategic:
  • Responsible to develop, implement and execute all strategic objectives and their deliverables for the pre-legal and legal functions within the Branch
  • In conjunction with, and as required by the Executive Officer Credit, contribute to the formulation, implementation and delivery of the bank’s strategy
  • Financial Management:
  • Responsible for planning and execution of the Branch’s budget and other financial targets; submitting and managing effective and efficient capital and operational budgets; and for the reduction of losses to the Bank and increase of revenue through collections and recovery
  • Operational Management:
  • Overall responsible for decision making regarding collection and other actions, such as compliance with legislation and regulation, institution of legal actions, provision for bad debt, settlement proposals, realization of securities, as duly mandated through the Authority Matrix
  • Maintenance of expert knowledge on relative legislative amendments, industry best practices and provision of proactive advice and solutions to relevant stakeholders
  • Identify how changes in legislation will affect the collection process and apply strategic changes in a pre-emptive attempt to lessen the effect of the change in legislation
  • Coordination Of Legal Collection Actions/Legal Processes:
  • Ensure the Benchmark of current practices against the Debt recovery and collection risk management framework are identified and adjust practices as and when necessary and executed as required
  • Improve business decisions by providing accurate and reliable business intelligence (information) together with analyzing trends and data for the debt recovery and collection environment by presenting findings to Credit Support
  • Stakeholder Engagement:
  • Responsible for handling internal and external clients and roles players in a professional manner and for providing correct information
  • Responsible for successfully negotiating and resolving relevant issues with legal representatives, branches and clients
  • Reports:
  • Responsible for effective and efficient compilation and checking of the Branch’s reports and ensure timeous submission to relevant stakeholders
  • Responsible for submitting monthly management reports/statistics as well as information on request
  • Departmental Management:
  • Evaluate the performance of personnel on a regular basis
  • Plan and manage performance, skills development, employment equity, talent and culture of team in order to improve innovation, achieve efficiencies and increase competencies
  • Ensure succession planning by adequate training and up skilling
  • Submission Of Management Information:
  • Responsible for submitting monthly management reports/statistics as well as information on request
  • Audit Evaluation:
  • Ensure to limit valid audit enquiries regarding conformance to legislation/Bank prescriptions
  • Comply with governance in terms of legislative and audit requirements, inclusive of policies approved and to be adopted
  • Routine Administration and Accounting Documentation:
  • Ensure effective management and control of all routine and accounting administrative activities related to legal collection in the branch in compliance with the Bank’s policies, procedures, rules and regulations
  • Compliance, Risk and Support:
  • Oversee the effective and efficient management and administration of legal collection internal processes and procedures to ensure compliance with the Bank’s risk framework to minimize risk
  • Collaborate with other relevant internal stakeholders such as risk department, internal auditing in managing all risks related to legal collections
Requisites
  • Experience/Knowledge & Skills:
  • At least 10 years’ relevant banking experience of which 6 years should be at Managerial level in a pre-legal/credit environment/legal environment
  • Proven ability to develop new business and maintain existing contacts
  • Excellent communication and leadership skills with an ability to influence at all levels
  • Experience with debt collection and sound knowledge of the entire collections value chain
  • Well versed computer knowledge
  • Knowledge of the system and processing activities
  • Knowledge of the legal collection service and legal processes in the Bank as well as those prescribed by Law
  • Analytical skills
  • Presentation, Negotiating and conflict resolution skills
  • Qualifications:
  • Master’s Degree in Law
  • Admitted Lawyer in the High Court of Namibia
  • Relevant qualification in management of financially distressed clients and non-performing loans
